A residence permit receipt may have implications for staying and working under Article 5(9-bis) of the Italian Consolidated Immigration Act. Not every receipt is a general work authorisation: the permit category, procedure, filing date, expiry of the previous permit and any official notice matter.

What does the law say about working with a receipt?
Article 5(9-bis) of the Consolidated Immigration Act governs the effects of certain first-issue or renewal applications while they are pending, when the legal conditions are met. The receipt and filing date alone do not confirm a right to work in every case.
The administrative decision period and the effects of a receipt are separate questions. A delay by the office should not, by itself, be treated as either work authorisation or automatic termination of work: check the permit category, procedure and any notice received.
For the EU single work permit, Legislative Decree 83/2026 provides, by way of derogation from paragraphs 9 and 9-bis, for issue within 30 days after the application is complete. This deadline concerns the single permit; it is not a general period for every permit and does not guarantee that a permit will be issued.
When does the receipt allow you to work?
Where the law applies and the requirements are met, situations such as these may be relevant. They are examples to check against the specific title and procedure:
- Timely renewal of a permit that already allowed work, subject to the rules for that category.
- First employment permit after signing the residence contract, where the procedure provides for it.
- Conversion to a work permit, for example from study or seasonal work, after the required steps are completed.
- First family permit after entry on a family reunification visa, in cases covered by the rules.
Does the receipt cover self-employment too?
For a renewal linked to self-employment, check the effect of the receipt against the application, filing date and permit category. Do not automatically extend rules from a different procedure to self-employment.
Any applicable tax and professional obligations, such as a VAT number, registrations and contributions, remain separate. The receipt does not replace those obligations.
When is the receipt not enough?
- When the permit category does not authorise work.
- When the application or renewal falls outside the cases or deadlines provided by law: holding a receipt does not automatically cure the situation.
- When an order or notice affecting the application has been served: check its content and stated effects.
- Students and applicants for international protection follow specific rules, separate from the general receipt framework; check the permit and relevant legislation.
Which documents should workers show their employer?
The employer must be able to check that the worker is compliant. These documents are usually provided.
- The postal receipt for the application, showing the date and tracking number.
- A copy of the previous permit, even if expired.
- A valid passport.
- The Italian tax code (codice fiscale).
- For a first permit, a copy of the signed residence contract.
The employer keeps copies and files the usual hiring notice (UNILAV). It helps to note when the final permit is expected.
What must employers do?
Before hiring, an employer should check the permit, the application filed and the applicable conditions rather than relying on the receipt alone.
- Check the filing date and type of application against the rules for that permit.
- Confirm that the permit sought allows the proposed work.
- Keep the relevant documents and monitor communications from the Questura.
- If an order or notice affects the right to work, promptly check its content, effects and deadlines; seek qualified legal advice on legal issues.
Can you change jobs while waiting for the permit?
A change of employer or activity can depend on permit type and the stage of the application. The new employer should check the worker’s status and applicable obligations before hiring.
The new employer files its own hiring notice. The worker brings the new contract to the Questura appointment or reports it at the next renewal.

How long is the receipt valid and what does it cost?
The receipt documents that an application was filed; its effects depend on the permit, procedure and any later notice or decision. Keep the original and check what it allows in your case.
Fees and contributions depend on the type of application and competent office. Check current amounts and payment methods through official channels before paying.
What if the decision exceeds the applicable period?
The applicable period depends on the procedure. Exceeding it does not, by itself, determine whether you may start or continue working: check the permit, application, receipt effects and any official notice.
