What happens when your residence permit expires?

Your permit card shows an expiry date; renewal must follow the deadline for its category. Legislative Decree 83/2026 took effect on 4 June 2026 and sets a 90-day period for the situations defined in the text: check whether your title is covered and review current instructions.

Missing this deadline does not make you undocumented overnight. Your position depends on how much time has passed since expiry.

  • Application sent before expiry: you are fully compliant and can rely on your receipt.
  • Expired less than 60 days ago: you can still apply, usually with no consequences.
  • More than 60 days without an application can have administrative consequences and requires an individual assessment; it does not automatically mean refusal or removal.

Article 13(2)(b) of the Italian Consolidated Immigration Act contains a specific ground linked to failure to renew. Check the current text and seek a qualified review before drawing conclusions about your case.

Can you renew a permit that expired more than 60 days ago?

Yes, in many cases. Italian administrative courts have repeatedly ruled that the renewal deadline is not a strict cut-off.

The police headquarters (Questura) cannot refuse just because you applied late. It must check whether you still meet the requirements, such as work, income and housing.

The delay still counts against you. The longer it is, the more important it becomes to explain and prove it.

Which reasons can justify a delay?

  • Illness or hospital stays, backed by medical certificates.
  • Being stuck abroad, for example due to border closures or serious family reasons.
  • Errors or delays by the authorities, such as no appointments available.
  • Waiting for essential papers, such as a new passport from your consulate.

Which documents do you need for a late renewal?

You need the usual documents for your type of permit. It is wise to add evidence that explains the delay.

  • The completed postal kit and copies of every passport page.
  • A copy of the expired permit.
  • Proof of your reason for staying: work contract, payslips, university enrolment or family documents.
  • Proof of income, such as a tax return or Certificazione Unica.
  • A certificate of residence or a rental contract.
  • A short written statement explaining the delay, with supporting evidence.

What if you lost your job in the meantime?

You can still apply if your contract has ended. In that case you ask for a job-seeking permit (attesa occupazione), after registering as available for work with the job centre.

This permit lasts at least one year. During that time you can look for a new job and then convert it into a work permit.

How do you apply and what does it cost?

The process is the same as a normal renewal. You send the kit from a post office and wait for your Questura appointment.

Once you have sent the kit, the receipt proves that you applied. From that moment your position is much stronger.

Can you work or travel with an expired permit?

What about the EU long-term resident permit?

The EU long-term resident permit has no end date as a status. The card itself, however, expires as a document and must be updated.

An expired card does not make you lose the status. Still, update it quickly, because you need it for work, banking, travel and council services.

Which mistakes lead to a refusal?

  • Waiting longer in the hope nobody checks: the risk of removal grows over time.
  • Applying without explaining the delay.
  • Failing to show regular income for the period that has passed.
  • Travelling abroad before you have a receipt.
  • Ignoring the notice of intended refusal: you have 10 days to send comments and documents.

After a refusal, the court, remedy and deadlines depend on the permit and legal basis. Keep the decision and promptly ask a qualified lawyer to calculate any applicable deadlines.

What should you check after a late application?

Can the Questura refuse renewal just because I applied late?
