This guide outlines grounds that may appear in a refusal notice and the documents to keep. Remedies and deadlines require a professional review of the individual case.

Why can the consulate refuse a visa?

For short-stay Schengen visas, the grounds are listed in Article 32 of the EU Visa Code. The most common are:

  • false or unreliable documents;
  • an unjustified purpose of travel;
  • insufficient funds;
  • 90 days out of 180 already used in the Schengen area;
  • an alert in the Schengen Information System (SIS);
  • a threat to public order or security;
  • no travel health insurance;
  • reasonable doubts about your intention to leave the Schengen area in time.

The last point is known as “migration risk”. Consulates have wide discretion here: they look at your job, income, family ties and assets in your country of residence.

What about long-stay visas?

For national visas, the specific requirements of each visa type apply, such as a work or family reunification clearance. Article 4 of the Consolidated Immigration Act also excludes people who threaten public order or have certain criminal convictions.

How is a refusal notified, and what must it contain?

The refusal must be in writing, in a language you understand or in English, French, Spanish or Arabic. Schengen visas use a standard form with tick boxes for the grounds and information on how to appeal.

The decision must give reasons. For security or public-order reasons, the consulate may omit them, but not for work, family, medical treatment or study visas.

Keep the complete decision and proof of its notification date. Deadlines, the effect of a review request and fee refunds depend on the applicable procedure; ask a professional to check them promptly.

What options should you assess after a refusal?

The remedy and competent authority depend on the visa type, refusal grounds and applicable law. There is no single procedure or deadline for every case: ask a qualified lawyer promptly to review the decision and calculate any applicable time limits.

A new application or a request for review

Before submitting a new application or requesting a review, compare each refusal ground with the documents filed. Do not assume an administrative request pauses a formal remedy deadline; ask a lawyer how the rules apply to your case.

If the decision mentions a SIS alert

Keep the alert reference and identify the authority named in the documents. A professional can check how to request access, correction or deletion under the applicable procedure. Do not assume a new application will change an active alert.

Family-related visas

Remedies can vary by family relationship and decision. Ask a lawyer to check the applicable route; you can also read our guide to a family reunification visa refusal.

What documents should you prepare for a review?

Keep the complete file and gather these items where available:

  • the full decision and proof of its notification date;
  • the visa application and every attachment submitted;
  • consulate correspondence and receipts;
  • documents that respond directly to the stated refusal grounds;
  • relevant translations, legalisations or apostilles, if required.

Do not send originals or sensitive data to unverified recipients. Formalities for any power of attorney depend on the proceeding; ask the professional handling the case for instructions.

How long can remedies take, and what might they cost?

Costs, timelines and legal fees depend on the applicable remedy, competent authority and facts. Ask a qualified lawyer for a case-specific estimate; do not rely on standard timelines or expected outcomes.

A successful challenge does not necessarily mean a visa is issued immediately; the effects depend on the decision and procedure.

What should you avoid after a refusal?

  • waiting for an informal reply without checking possible deadlines;
  • resubmitting the same documents without addressing the stated grounds;
  • assuming every visa follows the same procedure or goes to the same court;
  • ignoring a SIS alert or failing to identify the authority responsible for it;
  • submitting inaccurate information or inauthentic documents.

Keep your correspondence and seek a prompt professional review. If you are unsure which visa to apply for, read our Italian entry visa guide.

Frequently asked questions

How long do I have to appeal an Italian visa refusal?

There is no single deadline for every refusal. The court, remedy and time limit depend on visa type and legal basis; ask a qualified lawyer to calculate the deadline promptly.

Do I have to wait before reapplying after a Schengen visa refusal?

There is no general waiting period for every new application, but reapplying without addressing the refusal reasons may not help. Review the decision and deadlines with a professional.

Does asking the consulate for a review stop the appeal deadline?

Do not assume a review request suspends or interrupts a remedy deadline. Ask a lawyer to calculate the applicable date immediately.

If I win the appeal, do I get the visa straight away?

A successful challenge does not always mean the visa is issued immediately; next steps depend on the remedy and decision. No result is guaranteed.

Is the visa fee refunded if I am refused?

Refunds depend on applicable rules and exemptions; check the official visa tariff and payment receipt.
