This topic deserves to be dealt with separately, so we recommend reading our dedicated guide.

Family reunification for children

Direct descendants (children, including adopted or foster children, grandchildren, etc.) under the age of 21, or dependants, and those of the spouse or same-sex civil partner are entitled to family reunification with an Italian citizen.

The definition of “dependent family member” is not clear, but the following aspects can be taken into account:

the payment of sums of money over a considerable period (again, a vague definition) is sufficient to show that a situation of real dependence exists, and it is not necessary to establish the reasons for that dependence;

the fact that the dependent family member is able to work, and may wish to work, in the host Member State is not an obstacle, nor is the fact that they already have some resources of their own (Reyes judgment of 16.01.2014, Case C-423/12).

Family reunification for parents

Dependent direct relatives in the ascending line (parents, grandparents), and those of the spouse or same-sex civil partner, are entitled to family reunification with an Italian citizen.

Here too, “dependent” is interpreted in the same way as above.

Family reunification for brothers, sisters, cousins, nephews and nieces

For any other family member, of any degree, who is a dependant or a member of the household of the Union citizen in the country from which they have come, or who, for serious health reasons, needs to be cared for by the Union citizen, entry is facilitated.

However, please note that since this is a facilitation and not a right, Consulates often reject visa applications from the brothers and sisters of Italian citizens, on the grounds that “there are reasonable doubts as to the applicant’s intention to leave the territory of the Member States before the visa expires”. In this case, you can only apply again, providing better evidence in support of the visa application, or appeal to the TAR del Lazio (Regional Administrative Court of Lazio).

If, on the other hand, the sibling of an Italian citizen is already in Italy on another basis (as a tourist, with or without a visa, or with another type of residence permit), they can apply for family cohesion with an Italian citizen under Article 19 of the TUI.

Family reunification with an Italian citizen under Article 19

Article 19(2)(c) of Legislative Decree no. 286 of 25 July 1998 states that foreign nationals living with relatives up to the second degree, or with a spouse, of Italian nationality may not be expelled. So who are relatives up to the second degree?

Residence permit for the brother or sister of an Italian citizen

Remember that this specific provision does not grant any particular right of entry into Italy but, where the people live together, relatives up to the second degree who live with the Italian citizen are also granted a residence permit for family reasons.

This is not the residence card for family members of EU citizens, which is reserved for the family members listed above, but a special Italian residence permit.

Please note: living together is a crucial requirement.

The degrees of kinship are as follows:

First degree: parents and children;

Second degree: grandparents, grandchildren, brothers and sisters.

What are the requirements for family reunification with an Italian citizen?

Family reunification of non-EU nationals with an Italian citizen requires only a few requirements:

Residence in Italy of the Italian or EU citizen;

Sufficient income, which is needed to obtain the 5-year residence card for family members of EU citizens; otherwise a 2-year residence permit is issued;

Family relationship.

Unlike ordinary family reunification with a foreign national:

NO nulla osta (family reunification clearance) from the Prefettura is required;

NO entry visa is needed if, from the country of origin, you can enter Italy without a visa;

NO suitable accommodation is required.

Which documents are needed for family reunification with an Italian citizen?

The documents for family reunification with an Italian citizen serve to prove that the requirements are met:

a valid passport or equivalent document;

an official document (e.g. marriage or birth certificate) proving the family relationship, legalised or apostilled and translated into Italian;

if required, evidence of being a dependent family member or of suffering from serious health problems that require the personal care of the Union citizen;

the identity document of the Union citizen;

declaration of hospitality (dichiarazione di ospitalità);

the Union citizen’s family status certificate (certificato di stato di famiglia) (to show that there is no other spouse in Italy; Il mistero dell’Art. 23 d.lgs. n. 30/2007” (Have we started discriminating against the family members of Italian citizens? The mystery of Article 23 of Legislative Decree no. 30/2007; in Italian) are legitimate.

At least it has been clarified that the family members who can join static Italian citizens are the same as those who can join mobile Italian citizens and EU citizens. This seems sensible; otherwise we would have faced a reversal of rights, whereby a foreign national (from an EU State) would have had more rights than an Italian citizen.

However, the question of whether family cohesion with an Italian citizen is fully possible directly in Italy remains open. We know that Article 19 of the TUI states that certain foreign family members of Italian citizens cannot be expelled, but that is not enough: it applies to a narrower circle of family members than that provided for by Article 2 of Legislative Decree 30/2007.

Logically, however, since family cohesion directly in Italy for a foreign family member of a lawfully resident foreign national remains the same whether or not the family member to be joined is in Italy, family cohesion with an Italian citizen should also remain unchanged.

In other words, a foreign national who meets the requirements for family reunification with an Italian citizen and who is already in Italy as a tourist (with or without a visa) or on another basis should be entitled to full family cohesion with an Italian citizen, as if they held a family reunification visa with an Italian citizen.

Permanent residence card under Article 17 of Legislative Decree 30/2007

After residing legally and continuously for 5 years, holders of the residence card for family members of EU citizens (Article 10 of Legislative Decree 30/2007) can apply for the permanent residence card for family members of EU citizens who are not nationals of an EU Member State (Article 17 of Legislative Decree 30/2007), valid for 10 years.

We would like to stress that, unlike an application for Italian citizenship, what is required is not continuous registered residence but continuous stay. If, for any reason, you have a “gap in your registered residence”, this does not affect your right (in fact, the historical residence certificate is not required).

The permanent residence card is useful for certain administrative formalities; for example, you will no longer have to prove to the competent authorities that you have a job or sufficient resources.

For employed or self-employed workers, the right of permanent residence of the Union citizen and their family members can be acquired before the ordinary five-year period in certain circumstances, such as:

retirement;

permanent incapacity to work;

working in another Member State.

How non-EU family members of Italian citizens can join them in Italy: eligible relatives, requirements, documents, visa, family cohesion and permits.

[107,92

post-6661","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-residence-permits","category-visas
["GET
