Foreign nationals who are legally resident must always carry their passport and residence permit, or the post office receipt while waiting for it.

In this article we answer a common question: if you are a foreign national without documents in Italy, what should you do?

First, we will look at the different situations, from foreign nationals who are legally resident in Italy but are not carrying their documents, to those who are completely undocumented. We will then explain how an undocumented foreign national can regularise their status directly in Italy.

Is it a crime for a foreign national to have no documents?

Let us start with Article 6(3) of the Testo Unico Immigrazione (TUI, Consolidated Immigration Act), which states:

“A foreign national who, when requested by public security officers and agents, fails without justified reason to comply with the order to show their passport or other identity document and their residence permit or other document proving their lawful presence in the territory of the State shall be punished with arrest of up to one year and a fine of up to 2,000 euros.”

This means that every foreign national must, when asked by public officials, show both their identity document and their permesso di soggiorno (residence permit) or another valid document.

Of course, the post office receipt and the Questura (police immigration office) slip, issued while you wait for your residence permit, serve as substitutes for the final permit and must always be carried with you.

If the foreign national is undocumented, that is, unlawfully present in the territory of the State, this penalty does not apply, but they may be expelled directly, as established by the Corte di Cassazione (Italy’s Supreme Court) in judgment no. 16453 of 27/04/2011.

But do not despair: there are some alternative routes you can follow.

Undocumented immigrant Italy: which routes to a permit exist?

An undocumented foreign national in Italy can obtain a residence permit directly in Italy, and therefore without having to return to their home country to apply for an entry visa, in the following cases:

an amnesty (sanatoria) issued by the Government;

marriage to an EU citizen or to a foreign national with a residence permit;

a family relationship with an Italian citizen;

an application for political asylum or international protection.

Is there an amnesty for undocumented foreign nationals?

As explained on this dedicated page (in Italian), an amnesty (sanatoria) is introduced at the Government’s initiative, somewhat like a debt write-off scheme, and allows undocumented foreign nationals already in Italy to regularise their position, bringing them “out into the open” with a domestic work contract.

There are no fixed dates, so it is pointless to count on an amnesty, because there is no way of knowing when the next one will come.

Can you marry an undocumented foreign national?

If you are an EU citizen or a foreign national with a residence permit and you are in a relationship with a foreign national who is unlawfully present in Italy, you should know that you can marry them. There are, in fact, no prohibitions linked to your spouse’s residence permit. What matters is that they obtain the nulla osta al matrimonio (certificate of no impediment to marriage) from their embassy.

This is established by the first paragraph of Article 116 of the Codice Civile (Italian Civil Code):

“A foreign national who wishes to marry in the State must submit to the civil registrar a declaration by the competent authority of their own country stating that, under the laws to which they are subject, there is no impediment to the marriage, as well as a document proving that their stay in Italy is lawful.”

The words “as well as a document proving that their stay in Italy is lawful” were declared unconstitutional by judgment no. 245 of 25 July 2011 of the Corte Costituzionale (Constitutional Court); the article had in fact been amended by Law no. 94 of 15 July 2009.

This is because the Italian State protects family unity and guarantees the inviolable rights of the person. The Court specified that the “inviolable rights” provided for by Article 2 of the Italian Constitution “belong to individuals not as members of a particular political community, but as human beings”, so that “the legal status of a foreign national must not be considered – as regards the protection of those rights – an acceptable ground for different and less favourable treatment”.

The procedure is the same as for an ordinary residence card for family members of EU citizens, as explained in our article.

How does family cohesion work for an undocumented foreign national?

Family cohesion (obtaining a family permit directly in Italy) for an undocumented foreign national follows the rules on family reunification, but it is essential that the foreign national’s relative is an Italian citizen. This is because we are considering the case of a foreign national who entered Italy without authorisation.

The family members with whom an undocumented foreign national can apply for family cohesion are those identified in Article 19(2)(c) of the Testo Unico Immigrazione, which prohibits the expulsion of “foreign nationals living with relatives up to the second degree, or with a spouse, of Italian nationality”.

Can you apply for political asylum or international protection?

Of course, anyone in the territory of the State always has the option of applying for protection from their country of origin, for reasons they will have to justify before the Commissione Territoriale (Territorial Commission for international protection), which will decide whether or not to grant protection to the applicant.

With a residence permit for political asylum or international protection you can work and apply for reunification with family members who stayed in your country of origin but, of course, you cannot return there. Read more in our guide to international protection in Italy.

Frequently asked questions

Do foreign nationals in Italy have to carry their documents?

Yes. Under Article 6(3) of the Consolidated Immigration Act, a foreign national who, without justified reason, fails to show their passport and residence permit when asked by public security officers can be punished with arrest of up to one year and a fine of up to €2,000. The post office receipt and Questura slip count as substitutes.

Can an undocumented immigrant get a residence permit without leaving Italy?

Yes, in a few cases: a government amnesty (sanatoria), marriage to an EU citizen or to a foreign national with a residence permit, a family relationship with an Italian citizen, or an application for political asylum or international protection. Outside these cases, the person would normally need an entry visa from their home country.

Can I marry a foreign national who has no residence permit?

Yes. The Constitutional Court, in judgment no. 245 of 25 July 2011, declared unconstitutional the requirement in Article 116 of the Civil Code to show a document proving lawful stay. The foreign partner still needs the nulla osta al matrimonio from their embassy. The procedure then follows the residence card for family members of EU citizens.

Which relatives of an Italian citizen protect against expulsion?

Article 19(2)(c) of the Consolidated Immigration Act prohibits the expulsion of foreign nationals living with relatives up to the second degree, or with a spouse, of Italian nationality. These are the family members with whom an undocumented foreign national can apply for family cohesion directly in Italy.

Official sources

Consolidated Immigration Act (Legislative Decree 286/1998) – Normattiva

Article 19(2) of the Consolidated Immigration Act – Normattiva

Italian Civil Code – Normattiva

Sources checked on 15 October 2026.
